Module Aims

To enable students to develop:

* a clear understanding of equity as a source of law with particular reference to the use of express and implied trusts.

* the ability to critically analyse the impact of equitable devices and remedies in English and Welsh law.

* the ability to critically evaluate the social and economic context of equity and to use these principles accurately in solving problems.

Content Summary

The module provides a wide-ranging examination of the laws relating to equity and trusts including:

* Examination of the historical factors which have developed equity and trusts as well as its contemporary role in society. In particular, the nature and definition of a trust, the requirements of certainty and the beneficiary principle will be addressed as well as the equitable remedies available to the courts. The module also looks at the constitution of trusts and the volunteer rule.

* Examination of implied trusts; resulting trusts and constructive trusts and their application generally as well as specifically to the family home.

* Focus on charitable trusts, cy-pres and selected equitable remedies (e.g. tracing) before finally dealing with aspects of trusteeship, its powers and responsibilities.
