Module Aims

To enable students to further develop:

1. their knowledge and skills in the area of employment law and practice; and

2. put the knowledge and skills that have been learned into practice through practical exercises basedon a case scenario

Content Summary

The module provides an examination of the key elements in relation to employment law and practice including:

Employee status and the contract of employment:

Different rules and rights associated with an employee / self employed contractor;
Section 1 Employment Rights Act 1996 requirements for a written statement of terms
and conditions of employment.
Rights of an employee / worker.

The rules and procedures relating to the Employment Tribunal:

The role of ACAS and early conciliation;
Instigatingand defending a claim;
Mediation,negotiation and COT3 settlement agreements.
CaseManagement Discussions and directions.
Employment tribunal hearing, schedule of costs, and appeals.

Law of Unfair Dismissal:

Instigating and defending a claim of unfair dismissal under the Employment Rights Act
1996;
Drafting an ET1 and ET3
ACAS Code of Practice

Redundancy

Procedural rules under the Employment Rights Act 1996.
Consultation and selection processes.
Settlement Agreements

Family friendly rights and procedures:

Maternity, paternity, adoptive and shared parental leave rights.

LO1 To demonstrate accurate knowledge, understanding and skills of employment law and practice and employ the applicable skills in this area.
LO2 Use legal knowledge and skill to identify the client’s objectives and the different means of achieving those objectives having regard to financial, commercial and personal priorities and constraints, costs, benefits and risks.
LO3 To identify the overall nature of the matter, plan or progress that matter through a series of steps and decisions including, where appropriate, drafting documentation.
LO4 Understand the key ethical requirements contained in the Solicitors Regulation Authority Principles of Regulation and Code of Conduct, understand where these may impact and be able to apply them in context.
