Module Aims

To enable students to further develop:

their knowledge and skills in the area of employment law and practice and put the knowledge and skills that have been
learned into practice through practical exercises based on a case scenario.

Content Summary

The module provides an examination of the key elements in relation to employment law and practice including:

Employee status and the contract of employment:

Different rules and rights associated with an employee / self employed contractor;
Section 1 Employment Rights Act 1996 requirements for a written statement of terms and conditions of employment.
Rights of an employee / worker.

The rules and procedures relating to the Employment Tribunal:

The role of ACAS and early conciliation;
Instigating and defending a claim;
Mediation, negotiation and COT3 settlement agreements.
Case Management Discussions and directions.
Employment tribunal hearing, schedule of costs, and appeals.

Law of Unfair Dismissal:

Instigating and defending a claim of unfair dismissal under the Employment Rights Act
1996;
Drafting an ET1 and ET3
ACAS Code of Practice

Redundancy

Procedural rules under the Employment Rights Act 1996.
Consultation and selection processes.
Settlement Agreements

Family friendly rights and procedures:

Maternity, paternity, adoptive and shared parental leave rights.

LO4 Understand the key ethical requirements contained in the Solicitors Regulation Authority Principles of<br />Regulation and Code of Conduct; understand where these may impact and be able to apply them in context.
