Module Aims

The module will introduce students to the structures, institutions, processes and personnel of the Anglo-Welsh Legal system.

The module will provide a basis for study for students to;

1. Develop knowledge, understanding and analysis of the sources of law, legal structures, institutions and personnel of the Anglo Welsh Legal system.
2. Develop knowledge, understanding and analysis of the social and political context in which it operates.

Content Summary

The module will cover the following indicative content in the form of study units:

• Institutions and Systems
The institutions of the English Legal system including the court structure, hierarchy, and jurisdiction and appeals system.
A comparative study of alternative systems and processes e.g., inquisitorial systems.
Features and operation of both justice systems – the Criminal Justice System and the Civil Justice System. Principles and operation of the Criminal Justice System
Principles of the Civil Justice System, ADR and Tribunals
Principles and rules relating to Access to Justice

• Sources of Law
Sources of law and the law-making institutions of the Anglo Welsh Legal system;
Primary Legislation, the structure of an Act of Parliament,
the rules of statutory interpretation, presumptions and aids to statutory interpretation and construction.
Secondary legislation.
Development of the common law and the doctrine of precedent.
European sources of law – EU and Council of Europe
The law-making powers of the Welsh Parliament

• Legal Personnel
Selection and role of key personnel of the legal system of England and Wales, both lay and professional – judges, magistrates, juries, solicitors and barristers and rights of audience.
A focus on the legal sector and delivery of legal services more broadly.
