Module Aims
The module will provide a basis for study for students to:
1. develop an understanding of the law and practice of Dispute Resolution in the context of a civil claim
2. develop an understanding of the ethics, skills, techniques, etiquette and conventions required of a presenting advocate
Content Summary
For the Dispute Resolution element, the module will consider:
· Analysis of merits of claim or defence
· Arbitration, mediation and litigation as an appropriate mechanism to resolve a dispute
· Pre-action considerations and steps
· Commencing, responding to or progressing a claim
· Case management and any interim applications relevant to a claim
· The evidence needed and disclosure steps required in commencing, responding to, progressing or defending a claim
· Preparation of a case for a trial, the trial and any post trial steps
· Procedures and processes relevant to costs involved in Dispute Resolution
For the Advocacy element, the module will consider:
• The skills required to identify and analyse the relevant facts, the legal context in which the factual issues arise, and how they relate to each other
• Summarising the strengths and weakness of the case from each party’s perspective
• Preparing the legal framework of the case, and a simple narrative outline of the facts
• Preparing the submission as a series of propositions based on the evidence
• Identifying, analysing and assessing the purpose and tactics of advocacy
