Module Aims

The module will provide students with an introduction to the substantive and procedural rules of the law relating to criminal evidence.

The module will provide a basis for study for students to:

2. Develop a clear understanding of the main principles of criminal evidence and their application in a practical context;
2. Apply and analyse the impact of the rules of evidence in a criminal trial;
Analyse the effectiveness of the rules of evidence.

Content Summary

The module provides a wide-ranging examination of the rules of criminal evidence. The module will cover the following indicative content:
· The burden (legal and evidential) and standard of proof.
· The rules of evidence in the criminal courts (including, hearsay, bad character and identification evidence).
· The law and procedures surrounding witnesses.
· The right to silence.
· The exclusionary rules of evidence
· Throughout the module the impact of the Human Rights Act 1998 is evaluated.
