Module Aims

The aim of the module is to provide the student with an understanding of International Business and Competition Law.

The module will provide a basis for study for students to:

Provide a practical and legal background to the nature and function of international trade and competition law and policies.

Enable students to apply these principles in a professional and competent manner in international and EU context including dispute settlement processes

Content Summary

The module will cover the following indicative content:

Introduction to international business and competition policies, framework for trade liberalisation, multinational enterprise, trade policies, protection of intellectual property, lobbies, corruption and incentives.

Trade in goods: protectionism, membership of the WTO, non-discrimination, prohibition of quantitative restrictions, prohibition of dumping and subsidies, anti-dumping actions and countervailing measures, rules of origin.

Trade in services and labour: EU law on trade in services, Provisions Governing Trade in Services in the North American Free Trade Agreement (NAFTA), International Labour Organisation, the human rights of workers, and Transnational Organized Labour.

Competition policies and discussion of dominance, strategic behaviour, anti-competitive mergers, horizontal and vertical agreements and government restrictions, remedies, sanctions, countervailing and retaliation measures, dispute resolution, arbitration and judicial review
