Module Aims
Introduce students to legal procedures and key legislation which affect public service organisations
Provide a broad overview of the legal system whilst focusing on issues that affect the operation and administration of public service organisations.
Content Summary
English Legal System, its different institutions and legal personnel. Development of common law and its influence on the law making process.
Crown Prosecution Service.
Public Service Organisation legislation Human Rights Act 1998, the provisions of the Police and Criminal Evidence Act 1984.
IOPC.
An analysis of criminal liability in terms of the external elements (actus reus) and the mental elements (mens rea) of a crime.
The concept of fault in relation to the judicial interpretation of intention, recklessness and negligence.
The law relating to homicide and the defences of loss of control and diminished responsibility (specific to murder and both provided for by the Coroners & Justice Act 2009).
Non-fatal violent offences, both sex offences, in particular the offence of rape, and other non-fatal offences.
