Module Aims

  • To develop knowledge of legal systems both national and European, which provide for or influence the nature of law making and legal provision within the United Kingdom. 

  • To provide for an understanding and analysis of law-making institutions, personnel and decision-making bodies within the Anglo-Welsh Legal System. 

  • To develop knowledge and evaluation of Constitutional Law and the student’s ability to analyse how the fundamental concepts and principles affect intellectual property law. 

Content Summary

This module provides a rigorous foundation in the legal and constitutional frameworks that underpin intellectual property law and decision-making within the United Kingdom. Students will develop an advanced understanding of the structure and operation of the Anglo-Welsh Legal System, including sources of law, law-making institutions, court hierarchy, judicial personnel, statutory interpretation and the doctrine of precedent. The module also examines the specialist institutions, tribunals and appeal routes relevant to intellectual property practice. 

Alongside the study of legal institutions and processes, students will critically explore the constitutional principles that shape the exercise of legal authority, including Parliamentary Sovereignty, the Rule of Law, Separation of Powers, devolution and governmental accountability. Through engagement with contemporary legal and policy debates, students will evaluate how constitutional and regulatory frameworks can influence the development, interpretation and enforcement of intellectual property rights. The module provides essential contextual knowledge for advanced study of intellectual property law and supports the development of professional legal analysis, research and decision-making skills relevant to practice within the intellectual property sector.
